Man Freed After Psychiatric Evaluation Delay

A 37-year-old man who spent more than four months on remand awaiting a court-ordered psychiatric evaluation has been released from custody after being sentenced to time served.

Harold Palma exited the Belize City Magistrate’s Court on Tuesday morning a free man, after pleading guilty to a charge of aggravated assault. Palma had been on remand since January of this year, and was ultimately sentenced to four months imprisonment, time he had already spent behind bars. Senior Magistrate Mannon Dennison handed down the sentence, noting that Palma appeared to have an understanding of his actions at the time of the offense. However, the court also acknowledged that Palma had been awaiting a psychiatric evaluation that was never carried out.  Reports are that the delay stems from the current lack of a government-employed psychiatrist to conduct such evaluations for prisoners, leaving Palma, and potentially others, in prolonged remand without assessment.  Outside the courtroom, Palma expressed relief at his release, indicating that his primary concern during his time in custody was simply returning home after months behind bars.  Palma, a Honduran national who has lived in Belize City since the age of eleven, told reporters that he intends to stay with a relative in the city. Questions remain, however, regarding his access to ongoing medical care, as he is believed to have a mental health condition requiring treatment.  The charge against Palma stems from an incident in January, in which he allegedly assaulted Police Constable Alleyia Wade while she was performing her duties. According to police, Palma was reportedly behaving aggressively at a bus stop, armed with a knife, and threatening bystanders when officers intervened. During the confrontation, he allegedly pulled the weapon on the officer and issued threats, prompting a response to disarm him.
