Historic CCJ referral from Belize High Court could shape regional trade law interpretation


A landmark legal development involving Caribbean Court of Justice and High Court of Belize is setting the stage for a historic ruling that could shape how regional trade law is interpreted across the Caribbean.  The CCJ, yesterday, held a case management conference for its first-ever referral from a national court, marking a significant milestone in the Court’s Original Jurisdiction. The referral stems from a matter currently before the Belize High Court involving G. Anwar Barrow and others against the Financial Services Commission and the Attorney General of Belize.  At the center of the case is the interpretation of provisions within Belize’s Companies Act, alongside broader questions tied to the Revised Treaty of Chaguaramas, the legal framework governing the CARICOM Single Market and Economy. Specifically, the issue relates to the prohibition of anti-competitive business conduct under the treaty.  Under its Original Jurisdiction, the CCJ holds exclusive authority to interpret and apply the Revised Treaty of Chaguaramas. When such questions arise before national courts, they must be referred to the CCJ for a definitive ruling. That interpretation is then applied by the local court to resolve the matter.  Despite this mechanism being in place for years, no referrals had been made until now. The development follows a sustained public education push by the CCJ, aimed at increasing awareness among judges, attorneys, and private sector stakeholders across the region about the referral process and their rights under CARICOM law. Belize was among the first countries to host these sessions when the initiative launched in 2022.  During yesterday’s conference, the CCJ issued directions for how the case will proceed. The substantive hearing is scheduled for May 19, and will be conducted via video conference.
