There has been a significant development in a high-profile constitutional matter concerning Belize’s electoral system, following rulings handed down today by the Caribbean Court of Justice the CCJ. The decisions involve Belizean activist Jeremy Enriquez and Senior Counsel Anand Ramlogan, in their case against the Office of the Attorney General and the Elections and Boundaries Commission. In one ruling, the CCJ dismissed an application by Enriquez seeking special leave to appeal. However, in two related matters, the regional court granted special leave and allowed the appeals brought by Enriquez and Ramlogan, with full reasons to be provided at a later date. The practical effect of those decisions means that key aspects of the case will now return to Belize’s Court of Appeal for full consideration on the merits. Earlier today, Enriquez and Ramlogan held a briefing via Zoom, where they spoke on the issue of judicial bias, confirming they have filed a complaint with the Judicial and Legal Services Commission alleging judicial misconduct and serious bias against Justice Hondora. At the core of the legal challenge are concerns over electoral boundaries and representation, with arguments that constituency divisions have not been updated in decades, despite significant population changes across the country. Enriquez spoke of his commitment to seeing constituencies properly balanced and of the financial burden that comes with pursuing the matter in court.
Following the rulings, the applicants described the outcome as a major step forward for constitutional justice and electoral fairness in Belize. When Senior Counsel Ramlogan was asked about the key constitutional issues that will now be examined when the matter returns to the Court of Appeal, he focused largely on the issue of judicial bias.
In closing the briefing, Senior Counsel Ramlogan made clear that Belizeans should expect a continued fight to have Justice Hondora removed from the case, saying that faith and confidence in his ability to be impartial and fair has been lost. Today’s rulings clear the path for Belize to move closer toward redistricting and ultimately, toward ensuring that every voter is fairly represented by the candidate they choose to elect.
